By accessing or using the MenuCraft Studio website and services at https://menucraft.studio (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. About the Service

MenuCraft Studio is an AI-powered food photo enhancement service. We transform ordinary food photographs into professional-quality images suitable for menus, delivery apps, social media, and other marketing materials.

Our Service includes AI-based image processing followed by manual quality review to ensure the highest standard of results.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

The Service is intended for business use by restaurants, food delivery services, catering companies, and similar food industry professionals.

3. Account Registration

To place orders, you may need to create an account. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the security of your account credentials.
  • All activities that occur under your account.

You must notify us immediately at hello@menucraft.studio if you suspect any unauthorized use of your account.

4. Orders and Service Process

4.1 Placing an Order

When you place an order, you select a pricing plan and upload food photographs for enhancement. By submitting an order, you agree to pay the applicable fees for the selected plan.

4.2 Processing

Your uploaded photos will be processed using our AI enhancement technology and reviewed manually for quality assurance. We aim to deliver results within the timeframe specified for your selected plan:

  • Basic: 24-hour delivery
  • Professional: 12-hour delivery
  • Enterprise: 6-hour delivery

Delivery times are estimates and not guaranteed. We will make reasonable efforts to meet these timeframes.

4.3 Revisions

Each plan includes a specified number of revision rounds. Revision requests must be submitted within 14 days of delivery. Additional revisions beyond your plan's allowance may incur extra charges.

5. Pricing and Payment

5.1 Fees

Current pricing is displayed on our website. We reserve the right to change prices at any time, but changes will not affect orders already placed.

5.2 Payment Processing

Payments are processed securely through Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service.

5.3 Pay After Approval

We operate on a "pay after approval" model. Your payment method is authorized at the time of order, but funds are only charged after you approve the final results.

5.4 Refund Policy

If you are not satisfied with the results after all available revision rounds, you are entitled to a full refund. Refund requests must be made within 14 days of final delivery. Refunds are processed to the original payment method within 5–10 business days.

6. Your Content

6.1 Ownership

You retain full ownership of all photographs you upload to the Service. We do not claim any ownership rights over your content.

6.2 License to Us

By uploading photos, you grant MenuCraft Studio a limited, non-exclusive, non-transferable license to use, process, and modify your photos solely for the purpose of providing the Service. This license terminates when your photos are deleted from our servers.

6.3 Your Responsibilities

You represent and warrant that:

  • You own the photos you upload or have the necessary rights and permissions to use them.
  • Your content does not infringe any third-party intellectual property rights.
  • Your content does not violate any applicable laws.

6.4 Prohibited Content

You may not upload content that is illegal, offensive, defamatory, or unrelated to food photography. We reserve the right to refuse processing of any content at our sole discretion.

7. Our Content and Intellectual Property

7.1 Service IP

All elements of the Service, including but not limited to the website design, logo, branding, AI models, software, and text, are the intellectual property of MenuCraft Studio and are protected by applicable intellectual property laws.

7.2 Enhanced Photos

The enhanced versions of your photos are delivered to you for your unrestricted commercial use. You may use them in menus, delivery apps, social media, websites, print materials, and any other marketing purposes without limitation.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract our AI models or proprietary technology.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automated tools (bots, scrapers) to access the Service without our written permission.
  • Resell or redistribute the Service itself to third parties.
  • Upload malicious files or content designed to harm our systems.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
  • MenuCraft Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

10. Indemnification

You agree to indemnify and hold harmless MenuCraft Studio from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

11.1 By You

You may stop using the Service and request account deletion at any time by contacting us at hello@menucraft.studio.

11.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice. In the event of termination for cause, no refund will be issued for completed orders.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Modifications to Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

For significant changes, we will make reasonable efforts to notify registered users via email.

13. Governing Law and Disputes

These Terms are governed by the laws of the European Union and the applicable national law of the country where MenuCraft Studio is established. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

If you are a consumer within the EU, you retain any mandatory consumer protection rights granted by the laws of your country of residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
